Empty Promises and Breach of Contract I had a great start working with Kleinbott, but their project manager only sold me on the idea he could make the website I requested. He was friendly, but obviously did not understand what I was expecting. He gave me a good price, but apparently this was for just a skeleton of a site. They wanted hundreds more per month to add content and maintain it. I tried to work with them, but it became hard to imagine the project was ever going to be the way I wanted. I spoke with my legal team to try to get my money back, but these people are out of Pakistan and hard to sue. This was my lawyer’s letter to Kleinbott: and they still didn’t fix the problem. (Personal information has been omitted) Dear Sir/Madam, I represent Ms. xxxxxxx, an Education Specialist and proprietor of the domain xxxxxxx. This letter serves as a formal notice of breach of contract by Kleinbott, and a demand for an immediate refund of the xxxxxx paid by Ms. xxxxxx for the development of a website that has not been completed as per the agreed terms. In our records, we have documented multiple instances of communications between Ms. xxxxxx and representatives of Kleinbott, including but not limited to texts, emails, and document sharing, where the scope and requirements of the website were clearly outlined. Despite these clear communications, the final product delivered by Kleinbott drastically falls short of these agreed-upon specifications. This constitutes a breach of contract and a failure to deliver services as promised. Ms. xxxxxx was assured by a senior consultant from your company, Wajieh, that Kleinbott had the capability and resources to develop the specified database directory of AI tools for educational and personal development use. Based on these assurances, Ms. xxxxxx entered into a contract with your company. However, the outcome has been deeply unsatisfactory, missing crucial functionalities, customizations, categories, tools, and forms, as explicitly stated in the requirements. Moreover, the delay in development and the subsequent refusal to adhere to the original agreement or provide a refund has placed Ms. xxxxxx in a difficult position. As a dedicated professional with significant personal responsibilities, including caring for four children and a handicapped brother, she undertook this project to create a valuable educational resource, only to be met with negligence and unprofessionalism. Therefore, we demand the immediate refund of the full amount paid (xxxxxx) to Kleinbott. Failure to comply with this demand will result in legal action being taken against Kleinbott, Wajieh, Sarah, Tabish, and any other parties involved in this contract. Please be advised that should this matter proceed to litigation, we will seek not only the refund but also damages, legal fees, and any other relief the court deems just and proper. Additionally, be informed that we intend to pursue all available remedies, including reporting your conduct to relevant authorities such as the Better Business Bureau and other consumer protection agencies. Ms. xxxxxx will also be revising her public reviews to accurately reflect her experience with your company, thereby exercising her right to inform others of the service she received. We expect a full refund of xxxxxx to Ms. xxxxxx within ten (10) business days of the date above. Failure to respond or an unsatisfactory response will result in immediate legal action without further notice. We hope for a swift resolution to this matter and trust that you will take the necessary steps to rectify the situation promptly.
